I guess it boils down to the old saying "attack is the best defense".
If you attack, you'd better make sure you win the war, because if you win, you decide the laws and rules in hindsight.
If you attack and lose the war, you'll end up like the Nazis. No matter how noble or honest your reasons to attack were, you end up as a "war criminal" because your enemy, whom you attacked, is deciding the rules of the game AFTER they've won - like the Communists/Bolsheviks at the Nuremberg Tribunals.
